Two weeks ago, I read that Alabama resident and adult bookstore owner Sherri Williams was trying - yet again - to get the US Supreme Court to hear her case about what have come to be known as the Alabama sex toy laws. I wanted to write a blog about it but I have been sick, both from a cold and also from the notion that this sex toy case is still an issue.

The issue is a 1998 law that - according to various sources - was actually aimed at prohibiting completely nude dancing in strip clubs, not sex toys. Even the bill’s sponsor, Tom Butler, acknowledges that the strip clubs (not the sale of sex toys) were the focus of the bill. But however it started, this is what Alabama folks are left with: a bill that prohibits the sale of “any obscene material or any device designed or marketed as useful primarily for the stimulation of human genital organs.” One can apparently possess but not sell these “devices” (e.g., vibrators, dildos, pocket pussies).

I have read that there is an exception for medical reasons, but come on. It is hard enough for people to buy condoms or to ask their healthcare provider about getting tested for sexually transmissible infections (STI). People often feel embarrassed about sex. It would not exactly be easy for many women who find it difficult to orgasm because of cancer treatments or genital surgeries or depression to go out and try to legally buy a vibrator “for medical reasons”. In a state that apparently has plenty of adults jumping ship and moving out of the state as it is, keeping this law on the books is not exactly progressive.

This is an opportunity for Alabama to publicly become progressive, sex-positive and to acknowledge the important role that sexuality often plays in relationships (and in all fairness, the law was temporarily overturned, but has gone back and forth in the courts and right now adult bookstores are apparently allowed to sell sexual devices thanks to a stay from the courts). Also, in fairness, Mississippi, Georgia and Texas (is anyone surprised?) have somewhat similar laws. Oh, and did I mention that violation of this law is punishable by up to one year in prison and a $10,000 fine? For selling a vibrator? Are you kidding me?
Fortunately, Chicago is full of wonderful adult stores including The Pleasure Chest, Egor’s Dungeon, g Boutique, Cupids, Early to Bed, Tulip and MANY more. Not to mention that in Chicago we have the Howard Brown Health Center, the Illinois Caucus for Adolescent Health, Chicago Pride, and a top notch Planned Parenthood group. We have sexual health information, services, resources and freedom here, folks. Not everyone is as well-served.

And fortunately for women and men in Alabama, even if their stores do have to stop selling these products (which would be a shame for the sex lives of Alabama residents as well as their economy), at least perhaps they can figure out how to buy sexual enhancement products online. Or maybe we can figure out an excellent grassroots effort where someone donates 10,000 vibrators and we distribute them free of charge throughout the great state of Alabama. Free orgasms for all! Just a thought.
